It is defined by service. MiCAR enumerates a closed list: custody and administration on behalf of clients, operating a trading platform, exchanging crypto for funds or for other crypto, executing orders, placing crypto-assets, receiving and transmitting orders, advice, portfolio management, and transfer services on behalf of clients. Providing one of those in the EU on a professional basis requires authorisation. Providing none of them means the label does not apply, however much crypto the product touches. The distinction that usually decides it is custody: whether the provider controls the keys on a client's behalf. It defines an e-money token, which references a single official currency, and an asset-referenced token, which references anything else: several currencies, commodities, crypto-assets, or a mix. Titles IV and III respectively, both applying since 30 June 2024, six months before the rest of MiCAR. Key consequences: - Only a credit institution or an authorised electronic money institution may offer an e-money token to the public in the Union. There is no separate lighter licence. - Holders have an unconditional right to redeem at par in the referenced currency at any time. That right cannot be waived or made conditional. - Issuers may not grant interest. Any benefit tied to holding duration counts, including discounts and equivalent benefits, and whether it comes from the issuer or a third party. - At least 30% of funds received against e-money tokens must sit in a separate account at a credit institution; the remainder in secure, low-risk, highly liquid instruments. - Referencing more than one thing moves a token from Title IV to Title III, which requires its own authorisation. A basket is the heavier regime, not the lighter one. - Issuing is about the token; CASP is about the service provided around it.
